Terms of Service
This Agreement governs the terms and conditions of the use of Bubble Bins, LLC (dba “Bubble Bins”) services and is between you (“Client”), as an authorized user of such services, and Bubble Bins. By submitting a Request for Service, you confirm receipt of and acceptance of this Agreement.
1. SERVICE
Bubble Bins provides contactless, curbside mobile trash and recycling bin cleaning for residential and commercial properties who utilize residential bins. Our industrial cleaning equipment is custom-built to clean trash bins and deliver great results. Bins with excessive build-up, construction material, grease or grime, may yield variable results. Although rare, extremely soiled bins may require additional service to reach our optimal cleanliness standard.
2. CLIENT RESPONSIBILITES
For Bubble Bins to provide its services, the Client is to abide by the CLIENT RESPONSIBILITIES. Failure to comply may result in service interruption and/or additional service fees as outlined below.
Bubble Bins will schedule the Client for NEXT DAY service. For Clients that have their scheduled garbage and recycle day on Friday, we will either service those on same day, and or Saturday. You will be notified of this during the sign up and onboarding period.
NEXT DAY SERVICE: The Client is responsible for placing bins curbside for pickup on trash collection day. Bins should remain empty and left curbside the NEXT DAY until 7PM to be cleaned. If bins cannot be left curbside, please leave them by the garage or side of the house. If any trash or recycling is placed in the bins it MUST be bagged. Bins with unbagged trash will not be serviced.
The Client may request to pay for additional bins by contacting Bubble Bins and/or adding additional bins during time of sign-up. Bins may NOT be rotated or substituted at any time.
AVAILABILITY
All trash and recycling bins must be available for servicing on the scheduled service date. If bins are not available, Bubble Bins will attempt to contact the Client through the telephone number on file. If contact cannot be made, Bubble Bins will continue their route and will be unable to service the Client’s bins. Payment will not be refunded in the event of a missed service due to unavailable bins. The Client is responsible to place all bins out on the scheduled service date. Any missing bins will be cleaned the next scheduled service visit.
RESCHEDULING
Rescheduling a missed service due to unavailable bins is at the discretion of Bubble Bins. It is the Client’s responsibility to request a rescheduled cleaning and to pay a $10.00 additional service visit fee. Once the $10.00 additional service visit fee has been paid, Bubble Bins will make every effort to service the Client’s bins on the next scheduled service visit to the area. If a rescheduled cleaning is not feasible due to route scheduling, the Client will not be billed for an additional service visit and bins will be cleaned on the next scheduled service visit.
ABSENT/OUT OF TOWN
If the Client knows he/she will not be available to put bins out for a scheduled cleaning, it is his/her responsibility to contact Bubble Bins to notify them no later than 6:00PM the night before the scheduled service.
CONTENTS OF BINS
Trash and recycling bins must be free of the following materials:
Unbagged trash and recycling items
Unbagged animal waste and any other biological waste
Compost bins
Chemicals, paint, glue or other adhesives
Other hazardous waste of any kind
Building materials (plaster, stucco, concrete, etc.)
Yard debris (leaves, branches, etc.)
CONDITION OF BINS
Trash and recycling bins should be in good working condition and not be in such disrepair that would cause damage to the cleaning equipment or prevent Bubble Bins from cleaning the bins properly. Any significant damage noted by Bubble Bins will be reported to the Client upon the first cleaning.
If Bubble Bins arrives to perform service and the above conditions are not met, the service will not be completed, and payment will not be refunded. It is the Client’s responsibility to request a rescheduled cleaning and to pay a $10.00 additional service visit fee. Bubble Bins will then make every effort to service the Client’s bins on the next scheduled service visit to the area. If a rescheduled cleaning is not feasible due to route scheduling, the Client will not be billed for an additional service visit and bins will be cleaned on the next scheduled service visit.
3. BUBBLE BINS RESPONSIBILITIES
If Bubble Bins fails to provide its services on the scheduled date of service for a reason other than the Client failing to meet its responsibilities in the paragraphs above, Bubble Bins will arrange for the service to be performed on the next possible area visit. If a rescheduled visit is not practical or possible, the Client will receive a credit on a future invoice for the missed service.
In the event of inclement weather or equipment failure which prevents Bubble Bins from operating, a notice will be sent to the Client and services will be rescheduled.
4. CHARGES
Upon receiving a request for service, Bubble Bins will issue an initial invoice to the Client. When paying the initial invoice, the Client must select “keep this card on file” for monthly recurring services. Clients paying for a One-Time cleaning do not need to select this option.
AUTOMATIC PAYMENTS
Payment for recurring services are automatically processed at the conclusion of each service visit. Bubble Bins will charge the Client’s debit or credit card on file for the appropriate service plan fee.
DECLINED PAYMENTS
Bubble Bins will notify the Client in the event payment is declined. It is the Client’s responsibility to provide alternate payment information and pay all amounts due upon request by Bubble Bins. Failure to do so may result in service interruption and possible suspension or termination of services.
DELINQUENT ACCOUNTS
After one month of non-payment, an account will be deemed as delinquent. Delinquent accounts will be suspended, and no further services will be provided until the account has been brought back into good standing. A 10% late fee of the total amount due will be incurred for each month (30 days) the invoice is overdue.
5. CANCELLATION OF SERVICE
Service may be cancelled at any time up to 48-hours before your next scheduled cleaning by sending an email to info@bubblebinscleaning.com. If notice of cancellation is not received prior to the 48-hour required notice, then your next service will take place as schedule and then your cancellation of services will take effect thereafter.
CANCELLING AFTER FIRST CLEANING
If the Client requests recurring monthly service and cancels after the first cleaning, the Client will be charged for a One-Time cleaning fee minus any payment previously received.
CANCELLING AFTER BI-MONTHLY CLEANING PLAN
If the Client requests recurring bi-monthly service and cancels after the first cleaning, the Client will be charged for a One-Time cleaning fee minus any payment previously received.
CANCELLING AFTER SPRING /FALL CLEANING PLAN
Client is to be billed up front for Spring/Fall cleaning, Client needs to cancel 48-hours prior to first scheduled cleaning. If client does not cancel prior to 48-hours, client will be charged $25 cancellation fee.
6. MODIFICATIONS
AGREEMENT
Bubble Bins reserves the right to amend this Agreement at any time by posting a revised version to www.bubblebinscleaning.com, and/or by emailing its Clients information regarding the amendment. All amendments and/or revisions are intended to improve our ability to provide Services.
SERVICE
Bubble Bins reserves the right to modify delivery of service at its sole discretion at any time. Bubble Bins reserves the right to refuse service in its sole and absolute discretion.
CHARGES
Bubble Bins reserves the right to change prices or implement new charges for use of its services at any time. Any changes in pricing will be communicated to the Client by email prior to the changes going into effect. The Client has the option to continue or discontinue the service at any time. Continued use of the service after such changes are communicated to the Client by email constitutes the Client’s acceptance of the modified charges as communicated to the Client.
7. GOVERNING LAW
9.1 Choice of Law Jurisdiction and Forum
This Agreement shall be governed by the laws of the State of Wisconsin without regard to its choice of law rules. In the event of any dispute, the venue for any litigation shall be the Circuit Court of Jefferson County, Wisconsin.
9.2 Attorney’s Fees and Costs
In the event that either party is required to retain the services of an attorney to enforce this Agreement or to defend against any cause of action, claim, or counterclaim brought by the other party pursuant to this Agreement, then the prevailing party will be entitled to recover the attorney’s fees and costs which it has incurred, in addition to other remedies to which it is entitled under applicable law, unless the adjudicator specifically finds that neither party is the prevailing party.
9.3 Force Majeure
Other than obligations regarding payments, neither party shall be in default or otherwise liable for any delay or failure to perform under this Agreement if such delay or failure is caused by an event beyond its reasonable control, including, but not limited to, any act of God, act of a common enemy, the elements, earthquakes, floods, fires, epidemics or war.
9.4 Waiver
Any failure or delay in exercising any of the rights or powers given to us in this TOS shall not operate as a waiver of such right or power, or affect our right to exercise the same or any other right at a later date.
9.5 Severability
Should any paragraph of this TOS be determined to be contrary to law, the remainder of the TOS shall be interpreted in such a manner as if the omitted portion had not been included.
